Terms of Service for New Build Solutions

These Terms of Service (“Terms”) govern your access to and use of the website located at https://newbuild.solutions (the “Site”), operated by New Build Solutions (“we,” “us,” or “our”). By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site.

Your use of the Site constitutes acceptance of these Terms and our Privacy Policy. You must be at least the age of majority in your jurisdiction of residence to use the Site.

Information provided on the Site regarding our services (including renovations and new builds) is for general informational purposes only. Any estimates, quotes, or consultations are non-binding unless and until formalized in a separate written agreement signed by both parties. We reserve the right to refuse service at our discretion, subject to applicable law.

4. Intellectual Property

All content available on the Site, including text, graphics, logos, images, branding elements, layout designs, and other materials, is owned by New Build Solutions or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. Except for personal, non-commercial use, you may not reproduce, modify, distribute, transmit, display, or otherwise exploit any Site content without our prior written consent.

5. User Content

If you submit or transmit any content to us (including feedback, testimonials, or inquiries), you grant New Build Solutions a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute such content for legitimate business purposes. You represent and warrant that:
  • You have the legal right to submit such content;
  • The content does not infringe any third-party rights; and
  • The information provided is accurate and not misleading.

6. Disclaimers

The Site and all content provided therein are offered on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. Our total cumulative liability for any claim arising out of or relating to these Terms or the Site shall not exceed the amount, if any, that you have paid to us for services directly related to the claim.

  • Your infringement of any third-party rights.

9. Termination

We reserve the right to suspend or terminate your access to the Site at any time, without prior notice, for any reason, including violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ottawa, Ontario.

11. Changes to Terms

We may modify or update these Terms at any time. Updated versions will be posted on the Site with a revised effective date. Your continued use of the Site following any changes constitutes acceptance of the revised Terms.

12. Miscellaneous

  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
  • Entire Agreement: These Terms constitute the entire agreement between you and New Build Solutions regarding use of the Site and supersede any prior agreements or understandings.
